Terms of Service

These Terms are an agreement between you and Outish. They cover who can use Outish, how subscriptions work, the rules for the community, and the important fact that meeting people in real life is your responsibility. By using Outish, you agree to them.
1. Acceptance of these Terms
By creating an account or using the Outish app (the "Service"), you agree to these Terms of Service and to our Privacy Policy. If you don't agree, don't use the Service.
2. Eligibility — you must be 18 or older
You must be at least 18 years old to use Outish. By using the Service, you represent that you are 18 or older, that the identity you verify is your own, and that you are legally able to enter into this agreement. Accounts found to belong to anyone under 18 will be terminated.
3. Your account and verification
- You must register with a valid phone number and complete identity verification (government ID + liveness selfie, processed by Stripe Identity) before you can access content.
- You're responsible for activity on your account and for keeping access to your phone and account secure.
- You agree to provide accurate information and not to impersonate anyone or create an account on someone else's behalf.
- One account per person. Creating accounts to evade a ban or verification is prohibited.
4. Subscriptions, billing, and trials
Outish is a paid subscription service. There is no free tier — payment and verification are what keep the community real and safe.
- Plans. Standard pricing is $29.99 per year or $3.99 per month. Limited founding-member pricing of $19.99 per year may be offered for a limited time. Prices are in U.S. dollars and may change; we'll give notice of changes as required by law, and changes won't affect the term you've already paid for.
- Free trial. New members may start with a 7-day free trial. Identity verification is required during the trial. If you don't cancel before the trial ends, your subscription begins and the applicable fee is charged.
- Auto-renewal. Subscriptions renew automatically at the end of each term until you cancel. You can cancel anytime; cancellation takes effect at the end of the current billing period.
- App-store billing. If you subscribe through the Apple App Store or Google Play, billing, renewals, and cancellations are handled by that store under its terms, and you manage them in your store account.
- Failed payment. If a payment fails, your account may be suspended — your broadcasts are hidden rather than deleted — until payment is resolved.
- Refunds. Except where required by law or store policy, fees are non-refundable.
5. Community rules and acceptable use
Outish is for genuine, real-life connection between people who know each other. You agree not to:
- Harass, threaten, stalk, intimidate, or harm anyone.
- Post content or broadcasts that are illegal, hateful, sexually exploitative, or that promote violence or self-harm.
- Use Outish to facilitate any crime, or to meet anyone for an unlawful purpose.
- Impersonate another person or misrepresent your identity, location, or affiliation.
- Add or attempt to contact people you don't actually know, or use the Service to spam, solicit, advertise, or recruit.
- Collect or share other members' personal information without consent.
- Interfere with, reverse-engineer, scrape, or attempt to disrupt or gain unauthorized access to the Service.
You are responsible for the content you post. Broadcasts and other content you create must comply with these rules. We may remove content and take action on accounts that violate them.
6. Meeting people in real life — your responsibility
Outish surfaces what your mutual friends are doing so you can choose to show up. Any interaction or meeting that happens in the physical world is solely between you and the other people involved. While we verify identities to reduce the risk of bad actors, we do not conduct background checks, we do not monitor in-person conduct, and we cannot and do not guarantee anyone's identity beyond verification, their behavior, or your safety. Use your judgment, meet in public when it makes sense, and take the same precautions you would in any real-world social situation.
7. Your content
You keep ownership of the content you post. You grant Outish a limited, non-exclusive license to host, store, and display your content as needed to operate the Service (for example, showing your broadcast to your mutual friends). This license ends when your content is deleted or expires, except for backups or as needed to comply with law.
8. Suspension and termination
- You may stop using Outish and delete your account at any time — see Account Deletion.
- We may suspend or terminate your account if you violate these Terms, if verification fails or is reversed, if your payment lapses, or if we reasonably believe it's necessary to protect members or comply with law.
- Sections that by their nature should survive termination (including content license terms, disclaimers, and limitations of liability) will survive.
9. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any member will behave lawfully or safely.
10. Limitation of liability
To the fullest extent permitted by law, Outish and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from interactions or meetings between members. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $100.
11. Governing law
These Terms are governed by the laws of the United States and the state in which Outish is established, without regard to conflict-of-laws rules. (Specific venue and arbitration terms to be confirmed with counsel before launch.)
12. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date and, where appropriate, notify you in the app. Continuing to use the Service after changes take effect means you accept the updated Terms.
